TERMS AND CONDITIONS
1. General
The General Terms and Conditions of Business are drawn up in accordance with the consumer protection regulations, based on the recommendations of the Slovenian Chamber of Commerce and Industry and the international codes for online and electronic commerce. The online shop "Piezo Pickups" (hereinafter referred to as the "Online Shop") is operated by the company Piezo Pickups, Simon Rezelj s.p., which is also a provider of e-commerce services (hereinafter referred to as the "Merchant").

The Buyer shall be bound by the General Terms and Conditions in force at the time of purchase (placing an online order). The User shall be specifically reminded of the General Terms and Conditions at the time of placing the order and shall confirm his/her awareness of them by placing the order.
By placing an order, the visitor to the online shop guarantees that he/she is a person of full legal capacity. By purchasing a product, the visitor becomes a customer and a user. He may subsequently, if necessary, regulate his subscription to the newsletter with the trader via the e-mail address info.piezopickups@gmail.com.
These General Terms and Conditions define the operation of the online shop, the rights and obligations of the visitor, the user and the buyer, and the business relationship between the Trader and the user as a buyer of products from the online shop.
2. Accessability of information
The trader undertakes to make them available to the user at all times:

the identity of the Trader (in particular the company name and registered office and the number of the register where the company is registered),

contact details to enable the user to communicate quickly and effectively with the Trader (email address, telephone, etc.),

information on the essential features of the products offered in the online shop, including any warranties (if there is no warranty written next to the product, there is no warranty for that product),

price information, which must be clearly set out and must show whether or not VAT is already included in the price,
-
information on the availability of products from the online shop,
-
the manner and conditions of delivery of the products or services, in particular the place and time of delivery,
-
information on how to pay,
-
information about the validity period of the offer from the online shop,

information on the period during which it is still possible to withdraw from the contract and the conditions for withdrawal,
-
information on the possibility of returning products or withdrawing from the contract,
-
information about the User complaint procedure and the contact details of the Trader's contact person for Users.
3. Product offer
Due to the nature of doing business online, the product range in the online shop is subject to frequent and rapid changes and updates without prior notice. Despite the Merchant's best efforts to provide the most accurate and up-to-date information, inaccuracies may occur in the price, description or stock information of a product. All product images are symbolic (see clauses 5. and 18.).
4. Payment Methods
The trader allows the user the following payment methods for the purchase of products from the Piezo Pickups online shop:
CARD PAYMENTS SUMUP :
Secure card payment via SumUp system (more info at www.sumup.si). After the order is received, we send the user detailed payment instructions via email. The user receives a unique and secure link through which to make the payment for a clearly specified amount.
Once payment has been made, the invoice will be sent to the email address provided by the user within 10 working days.
If the User does not make the payment within 7 days of receiving the SumUp payment link, his/her order will be cancelled. There is no cost to the user.
The order will be sent to the address provided after payment has been made.
We also offer other payment methods, subject to the user's agreement with the trader.
CASH ON DELIVERY:
We do not offer this option at the moment.
PREPAID:
By prepayment of the purchase price to the Trader's transaction account according to the invoice, which is sent to the Buyer by e-mail. The reservation of the ordered items shall be made immediately after the payment has been made. The period for payment of the invoice shall be three (3) days, which is the same period for which the reservation for the ordered items is valid. Upon expiry of the payment period, or at the latest seven (7) working days from the date of sending the invoice, the order shall be cancelled and the reservation released. Holidays and weekends are NOT included in the payment period. If the Merchant receives payment after the expiry of the invoice validity period and has not confirmed the extension of validity and payment of the invoice, the Merchant shall not be obliged to refund the purchase price paid in the event that, as a result of the release of the reservation, the item in question has been sold or is no longer in stock.
PAYPAL:
Secure payment via PayPal payment link or bank transfer. Other terms and conditions are the same as for SumUp payment method.
PERSONAL COLLECTION:
The trader and the buyer agree to collect the goods in person at an agreed place at an agreed time. Payment may be made by any of the payment methods listed or by cash. An invoice will be sent to the Buyer's email address after payment has been made.
5. Prices
The online price applies to all registered users of the Trader's online shop.
All prices in the online shop are quoted in euros (€). The trader is not subject to VAT. All prices are valid only for the electronic order of products via the online shop.
Discounts are not cumulative and promotions are mutually exclusive, unless explicitly stated otherwise.
All prices are valid at the time of ordering and have no pre-determined validity and are therefore valid only until changed from time to time. Despite the Merchant's best efforts to provide the most up-to-date and accurate information, it is possible that a price may be incorrect. In the case referred to in the preceding sentence and in the event that the price of the product changes during the processing of the order, i.e. from the moment of placing the order until the order is confirmed, the Merchant shall:

notify the user (customer) of the new prices, in which case the user (customer) shall have the option of modifying or cancelling the order in whole or in part or confirming the order at the new prices, all at no additional cost; or
-
enable the user (buyer) to withdraw from the purchase and at the same time offer a win-win and mutually satisfying solution.
Deposits made under vouchers, other bonuses and pre-accounts do not earn interest.
6. Purchase procedure
1. Order accepted
After placing an order, the user (buyer) receives an email from the Merchant notifying that the order has been accepted and further instructions for making payment. Within 1 hour of receipt of this notification, the User (Buyer) has the option to cancel the order without any consequences. Except for the cancellation option, the user (buyer) cannot change the content of the order after the order has been placed.
2. Order confirmed
If the user (buyer) does not cancel the order, the order is processed further. Upon receipt, the trader checks the order, verifies the deliverability of the ordered products and confirms or rejects the order with a reason. The trader may also contact the user (buyer) by telephone on the contact telephone number provided to verify the information or to ensure the accuracy of the delivery. At this stage, the contract of sale for the purchase of the ordered Products between the User (Buyer) and the Trader is irrevocably concluded (see clause 7).
3. Goods dispatched
The trader prepares and dispatches the ordered products within the agreed time limit and notifies the user (buyer) of this by e-mail.
7. Purchase contract and invoicing
When a user buys a product from an online shop, the trader issues an invoice in written or electronic form, with an itemised cost. The purchase contract in the form of a purchase order is stored electronically on the Merchant's server. The Purchase Agreement shall be concluded in the Slovene language.
The purchase contract between the Merchant and the User (Buyer) is concluded at the moment the Merchant confirms the order (see clauses 6.2 and 6.3). From that moment on, all prices and other terms and conditions of the purchase are fixed and apply to both the Merchant and the User (Buyer).
8. Vouchers, gift vouchers, value vouchers, loyalty schemes and prize draws
A voucher, gift voucher or value voucher can be used by the user (customer) in the online shop with a password that has been obtained or made public. To use a valid voucher, please make the password clear in the comments section when placing the order so that it will be taken into account at the time of purchase.
The Loyalty Programme terms and conditions will be published from time to time and will apply for the duration of the Loyalty Programme. The Loyalty Programme Participant agrees to and acknowledges that he/she is aware of the Loyalty Programme General Terms and Conditions
The instructions and terms and conditions of the prize draws will be published from time to time and will apply for the duration of the prize draw. The entrant agrees to and acknowledges that he/she has read and understood the terms and conditions of the Sweepstakes.
9. Warranty for Piezo Pickups Products
Scope
This Limited Warranty applies to all Piezo Pickups branded products, and only those products. These are VIBE series microphones and Touch tapes.
What does this limited warranty cover?
This Limited Warranty covers any defects in material or workmanship under normal use during the Warranty Period. During the Warranty Period, Piezo Pickups s.p. will repair or replace, at no charge, products or parts of a product that proves defective because of improper material or workmanship, under normal use and maintenance. Piezo Pickups s.p. will also cover shipping costs associated with shipping those repairs or replacements from the seller to the customer.
What does this limited warranty not cover?
This Limited Warranty does not cover any problem that is caused by: conditions, malfunctions or damage not resulting from defects in material or production. It moreover does not cover consequential damages, or damages caused by the Product. It does not cover shipping of returned goods from customer to seller.
How long is the warranty period?
The Warranty Period for Physical Goods purchased from Piezo Pickups is 1 year from the date of purchase. A replacement Physical Good or part assumes the remaining warranty of the original Physical Good.
What will we do to correct problems?
Piezo Pickups s.p. will either repair the Product at no charge, using new or refurbished replacement parts; or will replace the Product with an identical or equivalent Product in the event that an identical Product is not available or Piezo Pickups decides that repair is not a good option.
Can a non-defective product be returned? Trial period?
Any product covered by this warranty can be returned for any or no reason within 30 days of the date of purchase, provided that the product is in the same condition it was in when it was purchased. This includes packaging.
If it is not being returned due to defects in material or workmanship, the original purchase price will be refunded, but the customer pays all associated shipping costs.
What do you have to do?
To obtain warranty service, you must first contact us at info@piezopickups.com and specify your problems and contact information. We will analyze the problem and the most appropriate solution for you. Please specify the date of your purchase and describe what problems you are facing while using your Piezo product. Our team will contact you through email as soon as possible.
The goods must be returned undamaged, in the correct packaging, with the original label.

We recommend using a delivery service that allows tracking and proper preparation of the goods for transport. Any return costs are the responsibility of the buyer.
What does this limited warranty cover for legal entities?
We allow companies, sole traders and other legal entities to return shipments of goods under warranty conditions. These organizations do not have the possibility to withdraw from the contract within 14 days of taking delivery of the goods without having to give a reason for their decision, as is the case for end-consumers.
11. Purchases for legal persons
The purchase procedure for legal entities is the same as that for natural persons, except that the company must be entered when providing the data and the terms of use must be agreed to.
Legal persons do not have the possibility to withdraw from the purchase contract within 15 days of acceptance without giving a reason. However, they may claim defects under a material defect or warranty.
For legal persons, the Piezo Pickups online shop offers the following payment method:

BY PREPAYMENT:
By prepayment of the purchase price to the trader's transaction account according to a prepayment invoice, which is sent by e-mail (see point 4 - PREPAYMENT).
12. Delivery
The trader will deliver the ordered products to the customer (buyer) within the agreed time limit. The trader reserves the right to choose any delivery service if this will enable the order to be fulfilled more efficiently.
Delivery times and rates are specified at checkout or agreed specifically with a customer.
13. Security and protection of personal data
The trader shall use appropriate technological and organisational means to protect the transmission and storage of personal data. The security is also the responsibility of the user by ensuring the security of his/her username and password and by ensuring that his/her computer is protected by appropriate software and anti-virus protection.
The trader (Piezo Pickups) undertakes to permanently protect all personal data of the user in accordance with ZVOP-1.
The Merchant (Piezo Pickups) shall store indefinitely the customer's data such as: first name, last name, e-mail address, contact telephone number, address, country of residence, time and date of registration and archive of communication with the Merchant (Piezo Pickups). The Merchant (Piezo Pickups) shall use the above personal data exclusively for its own purposes (delivery, sending of materials, offers, invoices) and for other necessary communication with the customers. Under no circumstances will the customer's data be passed on to unauthorised persons.
14. Communication and newsletters
The trader (Piezo Pickups) will contact the user (buyer) using remote communications, unless the user (buyer) expressly objects to this.
The emails will contain:

clearly and unambiguously indicate that they are advertising messages,
-
the sender of the Piezo Pickups will be clearly visible,
-
campaigns, promotions and other marketing techniques will be labelled and the conditions for participation will be clear,
-
how to unsubscribe from the newsletter will be clearly explained.
15. Childcare
The trader shall not accept orders in the online shop from someone he knows or suspects to be a child without the express permission of the child's parents or guardians. The trader shall not offer free access to products or services in the online shop that are harmful to children.
The trader will not accept any personal data concerning children without the express permission of the parents or guardians, nor will the trader disclose any data received from children to third parties other than the parents or guardians.
Any communication aimed at children will be age-appropriate and will not exploit children's trust, lack of experience or sense of loyalty.
16. Privacy Policy
The Privacy Policy is also part of these General Terms and Conditions and is available HERE.
17. Limitation of liability
The Trader shall use its best endeavours to ensure that the information published in its online shop is up-to-date and correct, but the characteristics of the products, the delivery date or the price may change so quickly that the Trader is unable to correct the information published in its online shop in time. In such a case, the Trader will inform the user (buyer) of the changes and give him the opportunity to cancel or modify the order (see point 5.).
Although the Trader endeavours to provide accurate photographs of the products for sale in the Online Shop, all photographs should be taken as symbolic. Photographs do not guarantee the characteristics of a product.
The trader shall not be liable for any physical damage, destruction or loss of the consignment from the moment the consignment of the products ordered is delivered to the post office, or if the contents of the consignment are missing or if the consignment shows signs of having been opened. In these cases, the user (buyer) must initiate a complaint procedure with the delivery agent. The trader, together with the delivery service, will ensure that the complaint is resolved as soon as possible.
18. Non-acceptance of products
The buyer is obliged to collect the ordered items within a certain period of time from the receipt of the electronic notification of the completed order, the sms confirmation of the completed order or the confirmation by e-mail. If the Buyer does not collect the ordered items, which are sent COD, in any case, and they are returned to the address of the company after the waiting period at the Post Office of Slovenia (4 days), this shall NOT be considered as a withdrawal from the contract, since the latter is still validly concluded and it is a unilateral unannounced withdrawal of the Buyer from the contract. In the event of non-acceptance, the Buyer is thus liable for the costs of additional shipping/return of the items to the Company, for the economic damages caused by the inability to advertise the ordered items that have been in distribution for 4 days or more. In the event of non-acceptance, the case shall be referred to the Legal Department, which will, under our authority, further arrange for the payment and recovery of the costs and damages incurred.
19. Complaints, disputes and application of the law
The trader complies with applicable consumer protection laws. The trader has an effective complaints handling system in place and has a designated person who can be contacted by phone or email in case of problems. In case of problems, the user (customer) may contact the Customer Service Centre at 040 855 491. The User (Customer) may submit a complaint by e-mail to info.piezopickups@gmail.com. The complaint procedure is confidential.
The trader will acknowledge receipt of the complaint within five working days, let the user (customer) know how long it will take to process the complaint and keep the user (customer) informed of the progress of the complaint. The Trader will use its best endeavours to resolve any disputes amicably. If no amicable settlement is reached, the Ljubljana court shall have exclusive jurisdiction to settle all disputes between the Merchant and the User (Buyer). The Merchant and the User (Buyer), as participants in electronic commerce, mutually acknowledge the validity of electronic messages in court.
These General Terms and Conditions and any disputes between the Merchant and the User (Customer) shall be governed by and governed by the substantive and procedural law of Slovenia, without giving effect to any rules of private international law that would refer to the application of any other law.
The provisions of the Code of Obligations, the Electronic Commerce Act, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis to all relationships and rights and obligations not governed by these General Terms and Conditions.
20. Out-of-court settlement of consumer disputes
In accordance with the legal norms, the online shop www.piezopickups.com owned by Piezo Pickups, Simon Rezelj s.p., does not recognise any provider of out-of-court settlement of consumer disputes as competent for the resolution of a consumer dispute that a consumer could initiate in accordance with the Act on Out-of-Court Settlement of Consumer Disputes.
Piezo Pickups, Simon Rezelj s.p., which as a provider of goods and services facilitates online trade in the territory of the Republic of Slovenia, publishes on its website an electronic link to the Online Consumer Dispute Resolution Platform (ODRP). The platform is available to consumers here.
These rules are based on the Law on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.
21. Changes to the General Terms and Conditions
In the event of changes in the regulations governing the operation of online shops, data protection and other areas related to the operation of the online shop of the Trader and in the event of changes in its own business policy, the Trader may amend and/or supplement these General Terms and Conditions, it is not necessary to inform the users each time, provided that they are not significantly affected by the changes. Any changes and/or amendments to the General Terms and Conditions shall come into force immediately.
